This information applies to our Saturday Vehicle Auctions only. This does NOT apply to Classic and Collector Car Auctions.

TERMS OF CONSIGNMENT

  • The entry fee is the only charge if your vehicle doesn't sell.
  • The entry fee is due at the time of consignment of your vehicle. No vehicles will be included in any advertising or in the Auction before being properly registered for the Auction. This includes delivery of Title to auctioneer's office. Reserved numbers are not cancelable at any time. If numbers are not filled, consignor will be responsible for paying the entry fee. An entry fee is due each time the vehicle is run through an Auction.
  • If your title and vehicle is not delivered at the time of registration, or by 9am the morning of the Auction, your consignment will be subject to a $50 Title Attached Fee. If your title is not delivered as described above and the auctioneers have to procure it following the auction, your consignment will be subject to a "Not Announced" Title Fee. Please have your paperwork in order at time of vehicle check in.
  • Consignments will be accepted until 12:00 PM the day before the sale. All vehicles & property left at owners' risk. Reserved numbers are not cancelable or transferable. Any person, entity or dealer leaving a vehicle for consignment on THCo property automatically agrees to the terms of consignment.
  • Payment terms: Consignors will be paid from proceeds within five business days of the Auction, providing all paperwork is in order, and Auctioneer paid. Purchasers are required to place a minimum 25% non-refundable deposit at time of sale, balance due at Auctioneer's office within two business days.
  • Consignors are asked to provide: at least 1/4 tank of fuel in vehicle, two sets of keys, top off all fluids, be sure vehicle has a strong battery (batteries available at auction shop). Auction company will provide one (1) jump start free of charge. Any jump start after that will incur a $10.00 fee.
  • Dealers are required to provide the following documents PRIOR to the Auction; Signed Power of Attorney form, Dealer Report of Sale, Title and/or Reassignment form, and Vehicle Keys.
  • Titles required on: Vermont vehicles manufactured in 1994 and newer; Boats manufactured in 1994 and after and 16' or longer. New Hampshire vehicles 1994 and after. Vermont and New Hampshire vehicles that do not require a title must be accompanied by the last current registration or vehicle will have to be sold to return to the state of origin. New York 1974 and newer.
  • Yard Sales: All Yard Sales must go through the auction office and are subject to commission and buyers fees, as posted.

REMOVAL
All vehicles purchased, sold or passed shall be removed from THCo property by 5:00 p.m. the first Friday following the auction. Vehicles not removed as outlined above will be subject to a $10.00 per day storage charge. Vehicles left after 14 days will be towed, impounded, charged storage and redemption fees, all at the owners' expense, unless other arrangements are made. This policy is strictly adhered to. Any vehicle left after 30 days without expressed written consent will be sold without reserve in the next auction following the 30 day period, to cover any applicable and accrued fees such as entry, selling, storage, etc. If there is any balance left after all fees have been deducted, said balance will be forwarded to consignor. Consignor agrees to hold harmless THCo, auctioneers, employees and agents from any claim arising from such action. THCo will not place vehicles outside the compound at any time for security reasons. If an owner wishes to pick up a vehicle during non-auction hours they may make arrangements with a THCo associate at a rate of no less than $10 per one half hour. Vehicle owner will pay associate directly, in cash.

THEFT
Thomas Hirchak Company does not take title to vehicles and does not assume responsibility for any theft or vandalism. The titled owner of the property must make a claim to his own insurance company.

MILEAGE, ODOMETER & BRANDED TITLES
The Auction assumes no responsibility for odometer mileage, nor the validity of the mileage statement provided by the seller to the buyer. The accuracy of the mileage that appears on any and all parts of the vehicle is the legal responsibility of the seller, under federal and state laws. All sellers will be required to buy back a vehicle with an odometer rollback problem. The auctioneers are required to notify the appropriate Law Enforcement Agency of any odometer rollback problems. Thomas Hirchak Company does not represent or warrant the odometer reading. Any vehicle with a branded title i.e.: (salvage/rebuilt, theft recovery, abandoned, etc.), must be disclosed to Auction.

Appropriate box must be checked by seller on bill of sale. Any vehicle that has had a branded title, washed & retitled as non-branded in another state must, by state law be disclosed. If not, seller will be required to buy back vehicle and pay any and all lost fees to Auction, and may be subject to criminal & civil prosecution.

MODEL YEAR
The auctioneer(s) assumes no responsibility for the year of the vehicle. The seller is responsible for the correct year on both the paperwork and the vehicles.

WARRANTIES
Any information on vehicle, such as "Runs Good" or "One Owner", etc. is considered to be implied warranty by the seller. The seller is responsible for any (mis)representations, and will be required to make right any discrepancies in the implied warranty. The auctioneer(s) is responsible in no way for any seller implied warranty. ALL PURCHASERS PROBLEMS, COMPLAINTS, ETC... WILL BE REFERRED TO THE SELLER.

WASTE DISPOSAL and TOXIC CHEMICAL LEAKS...
Excessive trash, chemicals, batteries, etc. will require a minimum $25.00 disposal fee. No vehicle will be allowed on THCo property that leaks gas, oil, antifreeze etc. Any vehicle that develops a leak on THCo property will be assessed a minimum $25.00 cleanup fee and may be subject to extensive cleanup charges as deemed reasonable by THCo.

OTHER
FAX transmittal that are needed to complete paperwork will be charged $1.00 per page and a $5.00 administration fee. Lost paperwork retrieval will be billed at $5.00 per page and a minimum of $25.00 per hour.
